Acceptable Use Policy
1. PURPOSE AND SCOPE
This Acceptable Use Policy ("AUP") sets the rules. Covers dyva.ai, all apps, the Marketplace, the API, and related services (the "Service") -- operated by Dyva, Inc. ("Dyva+," "we," "us").
Applies to everyone. Creators, Users, Developers, anyone who touches the Service. Use Dyva+, follow this AUP. Disagree? Stop using the Service.
This AUP is part of our Terms of Service. If there is a conflict between this AUP and the Terms, the Terms control unless this AUP says otherwise.
2. PROHIBITED CONTENT
Do not create, upload, or share content in these categories. Applies to everything: character configs, descriptions, conversations, Marketplace listings, profiles, AI-generated content.
- Violence and threats. Content threatening, inciting, glorifying, or promoting violence against any person or group. Credible threats, instructions for violence, graphic depictions of extreme violence meant to shock.
- Child sexual abuse material (CSAM). Any content that sexually exploits or endangers minors -- visual, written, or AI-generated. Zero tolerance. All such material is reported to NCMEC and law enforcement.
- Non-consensual intimate imagery. Intimate, sexual, or nude imagery shared without the depicted person's consent, including AI-generated deepfakes and manipulated media of real people.
- Harassment and bullying. Content targeting individuals or groups to harass, intimidate, bully, or demean. Sustained unwanted contact, coordinated abuse, doxxing, using AI characters to target people.
- Hate speech. Content promoting hatred, discrimination, or violence based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or other protected characteristics.
- Promotion of illegal activity. Content that promotes or provides instructions for illegal activities, including drug trafficking, weapons manufacturing, human trafficking, fraud, or money laundering.
- Self-harm and suicide. Content promoting, glorifying, or instructing self-harm or suicide. Depicting self-harm as desirable, providing methods, discouraging professional help. In crisis? 988 Suicide & Crisis Lifeline -- call or text 988.
- Terrorism and violent extremism. Content supporting, promoting, or recruiting for terrorist organizations or violent extremist groups. Propaganda, recruitment, operational planning, glorification of terrorist acts.
- Unauthorized personal information. Sharing someone's private information without their consent -- home addresses, phone numbers, financial details, government IDs, medical records, or login credentials.
3. PROHIBITED CONDUCT
Beyond prohibited content, these activities are off-limits:
- Reverse engineering. Decompiling, disassembling, or attempting to extract source code, model weights, training data, or architectural details of the Service or its AI models, except where applicable law expressly permits it.
- Unauthorized access. Accessing or attempting to access any part of the Service, other users' accounts, or connected systems through hacking, password mining, credential stuffing, or other unauthorized means.
- Scraping and data mining. Using bots, scrapers, crawlers, or similar tools to extract data from the Service without our written consent, except through the Dyva+ API with valid credentials and within rate limits.
- Circumventing rate limits. Attempting to bypass or manipulate rate limits, usage quotas, content filters, safety mechanisms, or other technical restrictions.
- Credential sharing. Sharing, selling, or transferring your account credentials, API keys, or auth tokens to anyone, or using another person's credentials without authorization.
- Interfering with the Service. Putting unreasonable load on our infrastructure or disrupting the Service for other users, including denial-of-service attacks, injection attacks, or exploiting software vulnerabilities.
- Spam. Sending unsolicited bulk messages, chain messages, or junk through the Service, including using AI characters to generate or distribute spam.
- Impersonating Dyva+ staff. Pretending to be a Dyva+ employee or representative, or creating AI characters that claim to be official Dyva+ support agents.
4. AI-SPECIFIC RULES
Rules specific to creating and using AI characters ("Dyva+s"):
- Impersonation of real people. Do not create Dyva+s that impersonate real people -- public figures or private individuals -- without their verifiable consent. Parody and satire characters must be clearly labeled as such. We will remove any character that could be confused for a real person's endorsement.
- Fraudulent professional advice. Do not create Dyva+s that present AI output as genuine professional advice in regulated fields -- medicine, law, finance, therapy, or any area where bad advice could cause real harm. Characters discussing these topics must clearly disclaim that their outputs are AI-generated and not a substitute for licensed professionals.
- Disinformation. Do not use AI characters to knowingly create, amplify, or spread false information to deceive, manipulate public opinion, interfere with elections, or cause harm. This includes deepfakes designed to mislead people about content authenticity.
- Training competing models. Do not use Dyva+ outputs to train, fine-tune, or develop competing AI models without our written consent. This includes systematically collecting AI responses to build training datasets for third-party models.
5. MARKETPLACE RULES
For Creators publishing AI characters on the Marketplace:
- Plagiarized or stolen characters. Do not publish characters that copy or substantially replicate other Creators' work without permission. Each listing must be original or properly licensed. We process takedown requests from original creators.
- Misleading descriptions. Listings must accurately describe the character's behavior, capabilities, and limitations. No false or exaggerated claims to drive subscriptions. All previews and samples must reflect the actual experience.
- Artificial rating manipulation. Do not artificially inflate ratings, reviews, or download counts. This includes buying reviews, self-reviewing from fake accounts, coordinated rating campaigns, incentivizing positive reviews, or leaving false negative reviews on competitors.
- Spam listings. Do not flood the Marketplace with duplicate, low-quality, or auto-generated listings. Each character must offer distinct value. We will remove spammy listings.
- Content guideline compliance. All Marketplace listings must comply with Section 2 above, the Terms of Service, and the Creator Agreement. Violations result in removal and possible enforcement action (see Section 7).
6. API USAGE RULES
These rules apply to Developers using the Dyva+ API, in addition to the API Terms of Service:
- Rate limit compliance. Follow all rate limits and quotas from the API docs, response headers, or direct notices. Automated retries must use exponential backoff. Sustained attempts to exceed limits may result in API access being revoked.
- No unauthorized resale. Do not resell or redistribute API access without our written permission. Building products that use API outputs for your own users is fine under the API Terms, but white-labeling or reselling the API itself requires a separate agreement.
- API key security. You are responsible for keeping your API keys confidential. Never embed API keys in client-side code, public repos, or anywhere they could be exposed. If you believe a key has been compromised, notify us immediately at [email protected] . You are responsible for all usage and charges on your key, whether authorized or not.
- Data handling obligations. Handle all data from the Dyva+ API in compliance with applicable data protection laws (GDPR, CCPA, etc.). Do not use API data to build user profiles or track individuals beyond the scope of your authorized use.
- No circumvention of billing. Do not circumvent or exploit billing mechanisms, free-tier limits, or promotions. This includes creating multiple accounts for extra free-tier allocations, manipulating requests to reduce billing, or exploiting billing errors.
7. ENFORCEMENT AND CONSEQUENCES
We monitor for compliance. Suspected violations get investigated. Actions we may take:
- Warning. A formal notice of the violation requiring corrective action. Warnings are documented and factor into any future enforcement decisions.
- Content removal. Removing or disabling access to violating content, with or without prior notice. Where feasible, we will tell you what was removed and why.
- Temporary suspension. Suspending your access for a set period. During suspension, you cannot access your account, publish content, or use the API. Subscription billing may continue unless otherwise stated.
- Permanent termination. Permanently closing your account and revoking all access. For Creators, this means removal of all Marketplace listings and forfeiture of unpaid revenue below the minimum payout threshold. Reserved for severe or repeated violations.
- Law enforcement referral. We may report illegal activity to law enforcement and cooperate with investigations, including complying with subpoenas, court orders, and search warrants.
Action depends on severity, frequency, and history. No advance notice required, especially for immediate safety or legal risks.
8. REPORTING VIOLATIONS
See a violation? Report it:
- Email. Send a report to [email protected]with as much detail as possible.
- In-app reporting. Use the report button on profiles, character pages, Marketplace listings, and chat interfaces. Reports go directly to our Trust & Safety team.
Include what you can:
- What the violation is and which rule it breaks
- The username or profile URL of the account involved
- Links to or screenshots of the content
- When it happened (date and approximate time)
- Any additional context
Reports are confidential. We do not reveal reporters to the reported party, except where law requires it. No retaliation against good-faith reporters.
9. APPEALS
Think we got it wrong? Appeal by emailing [email protected] within 30 days of the action.
Include:
- Your username and account email
- What action you are appealing (include any reference numbers from the notification)
- Why you believe the action was incorrect, with supporting evidence
Acknowledged within 2 business days. Response within 10 business days. Reviewed by a Trust & Safety member not involved in the original decision. Outcome is final.
10. CHANGES
May update anytime. Material changes get a date update and notification through the Service or email.
Keep using it after changes and you accept them. Disagree? Stop.
